Oxford Prep Chino Valley Request for an Immediate Stay

On Wednesday, June 28, 2017, Oxford Preparatory Academy’s attorneys filed a Request for Immediate Stay and Petition for Writ of Supersedeas in the California Court of Appeal, Fourth Appellate District. This Request is the first step in Oxford’s appeal process, and seeks an immediate Court order staying of the expiration of Oxford’s Chino Valley charter and preventing the loss of its facility until the merits of Oxford’s appeal can be heard. Absent the Court’s intervention, Oxford’s charter will expire on June 30, 2017.

Oxford’s Request argues the inherent power held by the Court of Appeal to issue appropriate relief in order to maintain the status quo and protect the school from irreversible harm pending the appeal process. The circumstances facing Oxford are urgent and unique, and pose important legal issues of first impression. The grant of Oxford’s Request will be up to the Court’s discretion.

Without the Court’s immediate intervention, the Chino Valley charter will lapse, our school will lose state funding and Oxford Prep Chino Valley will close pending the outcome of its appeal.

Petition for Writ of Mandate Denied

On Friday, June 23, 2017, Oxford Prep Chino Valley appeared before Judge David S. Cohn to pursue a Writ of Mandate, which sought judicial review of Chino Valley Unified School District’s November 2017 denial of our charter renewal petition.

At the hearing on the merits of Oxford’s Writ, Judge Cohn emphasized that Oxford’s counsel made “very compelling arguments based upon the legislative idea that once the charter is granted … it should go forward” and remarked that the matter is a “very close call” and one “of first impression.” Ultimately, however, the court declined to issue a writ of mandate or impose any injunctive relief. Judge Cohn urged Oxford to appeal his decision.

What to Expect
